Tokyo’s manga ban has been signed into law after passing a final vote, and is set to come into effect in 2011, with Tokyo governor Ishihara crowing that “Japan still has some common sense left after all!”

The ban already passed a committee vote, and as expected also passed a final vote on the 15th – the law stipulates that “voluntary restraints” must begun in April of 2011, with the full force of the ban to come in July.

All the major parties supported the ban – the ruling DPJ (leftist) insisted on a “prudent application” rider but otherwise did nothing to oppose the law as they did with the previous bill.

The LDP (right-wing) proposed and supported the original and current version of the bill. Their usual coalition partners, the Koumeito (the political arm of a Buddhist cult), also supported the bill, leaving only small parties to the left of the DPJ to oppose it.

Once again the motives of the DPJ can only be guessed at – they have repeatedly blocked national bans on possession of child pornography (already illegal to distribute) on civil liberties grounds, opposed the previously rejected version of the bill because it was worded as a ban on “virtual child pornography,” and actually insisted the just passed Tokyo law remove a “duty not to possess [real] child pornography” clause.

However, when the current bill’s wording was changed to ban depictions “promoting illegal or immoral sexual activity” (effectively a vastly more far-reaching ban than previously) rather than “[virtual] sexual activity involving minors” (this version of the ban was clearly targeting loli manga) as in the current version, their previous opposition all but evaporated.

That the law explicitly excludes photographic material can probably be interpreted both as a specific attack on “otaku” culture and an effort to avoid antagonising Japan’s mass media, who obviously would not support any restrictions on themselves but are only too happy to support them on other industries.

The 10 publishers who have boycotted the Tokyo Anime Fair are angry at the treatment meted out to the industry by Ishihara and his cronies:
“The earlier bill was defeated with heavy opposition, and we are indignant that the bill should be resubmitted in so short a time.”


Kadokawa’s CEO has vowed opposition will continue, although just what publishers can do about it is not clear, particularly in light of their evident ineptitude in handling politicians.

Ishihara for his part is crowing over the industry’s defeat:

“It makes sense for this to have passed – Japan still has some common sense left after all!”


In interviews he merely laughed at the industry boycott:

“If they’re outraged about this then they shouldn’t come. They’ll come the next year, for sure.”


Veteran shoujo mangaka Machiko Satonaka speaks of complete betrayal at the hands of the politicians:
“There were representatives who promised us ‘we won’t resubmit the bill without consulting manga and anime producers,’ but they submitted it anyway, so I feel we were tricked. There are many issues with the ordinance, in particular the ‘improperly promote or glorify [sexual activity]‘ passage, and there is no way we can accept this.


In particular, I worry about the future for young mangaka – I hope they will persevere without the industry falling into decline.”





I don't think (hope) the plug suits will be affected, but fanservice on movies and stuff like the test plug and all those Rei*/Asuka moe illustrations will problably bannable in any media !!!
I expect kharas income to drop 99,9990236% !!! What of the future of the movies !!!

Edited title to be more accurate -- the measure allows you to sell your Adult-Only loli doujins (and pre-teen idol DVDs) exactly as before.

I disagree with this even a very minor unknown and unloved show could deal with the same imagery and character voice with out justifiably being seen as immoral.

Evangelion's films and TV programming is not a immoral creation in content (but perhaps in the minds eye of fandom imagination it is.. so its understandable you would be worried)

It is very interesting new bill as it highlights humans ability to materialise objectifiable creations with only raw simulated materials . and makes us question what is worse the idea or the physicality of some thing. Quite ironically a theme of the anime would you say?

I don't understand shit you're saying.

Technically they could "outlaw" Evangelion if they wanted. If EoE were to come out next year it would end up with 18+ tag in a heartbeat. But eva's institution, no newbie show with suspicious and controversial reputation. Hence it's safe.

You have to remember that these films are being presented in theaters, so if anything, there might be a slight adjustment in the rating of these films. (If the Rebuild's were PG 13, under this new law they might be 14A)

I'm not talking about just the movie, think of those illustrations sadamoto does to promote the movies in diferent merchandising sexualizing the girls, that are 14 ,and thus minors.

I don't think Evangelion could be seen as unjustifiably glorifying/exaggerating sexual or pseudo-sexual activity. Unless Q seems to give the message that Shinji having sex is the right thing to do, it'll be fine.

I'm really struggling to understand what this bill means. Is it just that now you will need to have ID showing that you are of legal age to purchase adult content?
What if I don't want to live in the real world?

My understanding, based on sifting a lot of froth on /a/ (so to be taken with a large pinch of salt) is

- they use a very coarse grained rating system (everyone or adult-only) for most things
- adult-only means porn of some sort
- stores sell one or the other (you have to go out of your way to get the adult-only material; in particular you won't find it on the top shelf of the rack with your Shonen Jump -- unless the extreme doomsayers are right and that gets AO rated too)
- AO material wouldn't be broadcast except perhaps upon some subscription channels (think the uncensored versions of anime appearing on the AT-X channel)
- the bill explicitly covers anime and manga only (so junior idol videos are still open access)
- the bill also contains some requirement to put age-related controls on mobile phone internet access

I have no idea what if any sort of system of rating for movies is used, nor how things are sorted into the different buckets. However, I expect -- as Xard suggests -- that cultural icons like Evangelion (and One Piece, Doraemon and Sazae-san) will get a bye on grounds of artistic merit.

The main impact on Rebuild looks like it would depend on whether Shinji/Rei is a) considered a relationship that could not end in marriage, b) they get down to business on screen, c) it's deemed to be excessive glorification of such.

I see... wouldn't putting an age rating on it and requiring ID for purchase work just as well?
On a slightly related note can I ask, in the US, dvd and games don't have a rating system that requires ID for purchase, no?

Junior Idol... I remember seeing dvd's with pictures of little boys in swimming trunks in a porn shop when I was in Ni-chome. I freaked and walked out, I thought they were selling child porn. I assume that's what you're talking about.

No matter what kind of control these guys do, some can just simply override it, like here in the Philippines for example. Kids get to view AO materials by lying about their age.

if you're familiar with sites that ask for your age in order to enter, then you'll get what I mean.

I seriously can't believe anyone will think Evangelion will be rated as "adult only." This stuff was originally intended for kids after all. But if it will be, it will be.
