As much as Rei can be considered the First Child. The two of them have different qualifications for piloting Evas than all the other pilots and potential pilots, but they certainly can pilot them.

Here's a better question: HOW did Kaworu get to be the Fifth Child? Pilots are selected by the Marduk Institute, which eventually turns out to be just Gendo. SEELE can't just dump some random kid on NERV's doorstep and say "he's a pilot now, deal with it"... can they?

They evidently can; remember, they are a kabal of rich old white dudes who run functionally the entire world through shell corporations. Some manipulation of information is nothing to them, neither in terms of effort nor conscience

Well considering the fact that Kaworu is the seventeenth Angel, And possesses Adam's soul, he was integral to Seele's plan. Which was to infiltrate Nerv
and enter Terminal Dogma to make contact with Adam ( which is actually Lilith) as the Fifth Child, and a replacement for Asuka, yet he was not assigned to an
Evangelion. So I guess that Unit 04 was originally meant to be piloted by Kaworu. So I guess he became Fifth Child on Gendo's behalf

That and the fact that Gendo and Seele, while rivals in some ways, maintained some facade of camaraderie at least until the moment the last angel was defeated. Gendo needed Seele and Seele needed Nerv and time. Otherwise, EOE could have happened right after episode 19 (when the two parties started to antagonize each other in earnest).
Seele was Gendo's boss. They were above him.

Also that, yes. Even while scheming against another, Gendo was still bound by their authority. This is very beautifully shown in one of Ritsuko's line, nonchalantly noting that Kaworu is probably the final angel: she knows, by extension Gendo and Fuyutsuki probably know, but have all accepted that at current, there's nothing that can really be done about that, because the order to take him in came from up the food chain, and getting in trouble with Seele while the final angel is still out there would cause way more problems than it solves
