Her position does make it problematic, certainly, but I don't think it would be a legal problem so much as a 'you just got fired' one. Then again, Gendo has no room to complain about fraternization with lesser officers. ...and quite possibly with minors as well. Surely there is a good reason why Rei doesn't live with him anymore... two reasons, most likely.

During their conversation at the love motel in episode 20, Misato and Kaji talk about their relationship as though it isn't much of a secret.
Not sure what that has to do with Misato having illegal relations with her charge, though.

I was throwing around the idea that Misato and Kaji's relationship has a bit of a secret side to it, and it does, at least with Kaji's gift. The same could've happened between Shinji and Misato and undoubtedly, it would've been kept as secret as possible. So while not very legal at all, the bigger question is would it have ever been known to anyone else?

Most scientists in the world would probably realize that cutting the world's population in half isn't necessarily a bad thing overall. Yes, a huge amount of people are dead, but it would severely slow down the exhaustion of resources and food and stuff. Global Warming would be slowed. Al Gore would be proud. If he didn't die.

Surely not... but I believe that changed when puberty showed up. Gendo likely found it harder and harder to stay objective on Rei when her resemblance to Yui and sexual attractiveness began to grow problematic for him. He likely needed some distance to keep from allowing such temptations to distract him.

I disagree......Rei is a daughter to him. If Gendo had a biological daughter who had resemblance of Yui like Rei did, would he find her sexually desirable? I don't think so, and I really hope not. Also, Rei doesn't really look like Yui except when she was young.

I don't believe so... not entirely, anyway. Considering how completely obsessed he is with Yui I don't find it at all problematic to suggest that Gendo might have had a little trouble dealing with the casual nude younger model.
He certainly does spend a significant amount of time watching her naked, usually asking her out for dinner afterwards... Ritsuko may have actually had good reason to be jealous. Also notice he goes right for the boob in EOE despite that apparently not being where he was trying to put the fetus.
It also has the convenience of explaining why the move was so recent, as implied by Rei starting public school just the year before. If Gendo wanted to keep her secret and under control wouldn't it have been easier to just keep her isolated from everyone but him?

I am making the inference of such, using the premise that "a 4-5 year old wouldn't be living by herself", and adding "Presumably" to emphasize that "a 4-5 year old wouldn't be living by herself" infers that "taking care of" = "living with".
Whether you take the premise as true or not is up to you.
I don't think Gendo would trust Rei's care/feeding/brainwashing to anyone but himself. She's far too important to his plan for anything less than personal oversight, at least during the critical first few years of her training. The very last thing he needs is someone showing undue compassion for the girl.
