Everyone present in Pre-HIP had already had their souls collected, IIRC. Misato when she died, Asuka when she died, Rei when she went god-mode, and Shinji was within the Eva. Mini-Instrumentality.

Far as a pilot goes, it's a fic so you really can do whatever you want. Gives you a chance to flex your creativity and see how one could possibly be justified outside of the Marduk Institute's jurisdiction.
